Caregiver Discrimination: The Next Claim Du Jour?
This session will explore hidden areas of potential liability for caregiver discrimination, proactive steps to avoid such claims and effective strategies to deter and, where necessary, defend against them.
The EEOC-issued guidelines on worklife balance state with little fanfare that existing
protected categories “might” support claims for caregiver or parental discrimination. Revised FMLA regulations, including military caregiver leave, further butress caregiver discrimination claims. This session uncovers when an employee’s personal responsibilities may be subject to protection and/or reasonable accommodation under existing employment laws and suggests effective strategies to deter and defend potential discrimination or retaliation claims due to employees’ personal responsibilities or relationships.
